PRIVACY POLICY

Nagevičiaus g. 3, LT-08237 Vilnius, Lithuania the data about the company is collected and stored in the Register of Legal Entities (hereinafter referred to as "the company"), is the controller of the personal data obtained when a person uses the company's products and/or services, as well as when he or she visits our web sites. This means that AG Cyber MB determines, independently or jointly with others, the purposes and means of the processing of personal data and undertakes to respect and protect the personal data and privacy of individuals. AG Cyber MB owns the trademark ACyber.

This privacy notice:

  • Defines the company's commitment and responsibility to protect and respect the privacy of individuals;

  • explains how the company collects, uses, and protects (processes) personal data;

  • informs data subjects about how their personal data is processed and what rights each data subject has.
     

In processing the personal data of data subjects, we comply with the requirements of European Union legislation, the Law on Legal Protection of Personal Data of the Republic of Lithuania, the Law on Electronic Communications of the Republic of Lithuania, and other directly applicable legislation regulating the protection of personal data, as well as with the instructions of the competent authorities.


The Privacy Notice (last updated in January 2024) applies to the use of the Company's products and/or services, as well as to visits to our websites. The Privacy Notice does not apply to the use of other companies' websites or services, even if they are accessed through the Company's network or services.

Definitions:

Personal data - any information relating to a natural person, the data subject, who is known or identifiable, directly or indirectly, by reference to the data concerned.
Data subject - any natural person: customer, employee, partner, or visitor of the company.
Customer - any person who orders, buys, or uses our company's services. A customer with whom the company has entered into a purchase transaction must ensure that all end-users (e.g. family members) who use the company's services ordered by the customer are aware of the privacy notice and comply with its provisions.
Personalized data - information that no longer relates to a natural person because all elements that allow the identification of the individual have been removed from the personal data set.
Services - any products and/or services offered by the Company, both electronically and non-electronically.

How do we collect your personal data?

The information we collect about you depends on the information you provide to us when you order services, or goods or send us messages or notifications using our website.

Sources of data. We collect the following data:

  • Data that you provide yourself, for example, when you interact or have a legal relationship with our company, such as when you purchase services or subscribe to newsletters, or when you contact us to request information;

  • data that is generated automatically when you use our services, or purchase products, to the extent permitted by applicable law, such as when you contact us, purchase our products, or use our services (e.g. when you make a telephone call, send an email, or visit our websites);

  • data we receive from other sources, such as other service providers or publicly available registers.

  • You are not obliged to provide any personal data to the Company. However, in certain cases, if you choose not to do so, we may not be able to provide you with goods and/or services.
     

What personal data do we collect from you?

We collect data belonging to the following categories:

  • basic information such as name, surname, and contact details;

  • data that relates to the provision of goods and/or services, billing, payment details, contact details, and related records;

  • data generated by means of communication, such as traffic data such as the date, time, duration of the connection, the subscriber number of the caller, the subscriber number of the subscriber receiving the connection, the IP address used by the Internet user during the connection, etc.;

  • other data about the use of services and/or goods, such as data collected through cookies and similar technologies related to web browsing, etc.;

  • other data which are collected on the basis of your consent and which are defined in detail at the time consent is requested from you.
     

How do we use your personal data?

The Company collects and further processes your personal data only on the basis of the lawful grounds defined in the legislation governing the protection of personal data - for the purpose of concluding and/or executing a contract with you; with your consent; when the processing of personal data is required by the relevant legislation or when the processing of personal data is necessary for the Company's legitimate interest (only if the interests of the data subject are not overriding).

The Company processes personal data for the following purposes:

  • Direct marketing. We process personal data (name, surname, email address, telephone number) for direct marketing purposes. We have the right to send direct marketing communications about similar goods and services by email to our existing customers, provided that they do not object. The basis for processing the data in relation to our existing customers is our legitimate interest (Article 6(1)(f) GDPR) - i.e. our aim to inform our existing customers about similar goods and services. You are given the right to express your objection in writing. On this basis, we will send you direct marketing communications unless you object and for a maximum period of 1 year from the last time you provided us with your information. In relation to potential customers, the legal basis for processing is consent (Article 6(1)(a) GDPR). This means that we will only send our communications to potential customers if they have actively expressed their consent. The data is processed for this purpose until you withdraw your consent. You have the right to withhold your consent or to withdraw your previously expressed consent at any time without suffering any negative consequences.

  • Analytics - We use analytics services to help us understand how our visitors interact with our website, needs. This involves collecting data about your visit to our site, such as the pages you view, the links you click, and other actions you take within our platform. The purpose of gathering this information is to improve our website's functionality, optimize its content, and enhance user experience. By analyzing this data, we can identify usage trends, tailor our services to better meet your needs, and ultimately provide a more effective online environment. The insights gained from analytics help us to make informed decisions about the design and development of our features and products.

  • Protection and defense of the Company's rights and legitimate interests. We process data for this purpose when responding to complaints and claims or when bringing/responding to legal actions. The legal basis is our legitimate interest (Art. 6, 1 (f) GDPR) - to defend our interests and to be properly represented before supervisory authorities. You have the right to object to such processing by notifying us of your reasoned objection. The data shall be stored until the date of the final decision and for as long as required by the legislation governing the archiving of documents.

  • We may also process the data for other purposes for which the company is entitled to process your personal data, e.g. in the event of an internal or external audit of the company, in the event of a sale, purchase, reorganization, or another restructuring, in the event of consultation with lawyers or other professionals, for the proper performance of our statutory obligations in relation to e.g. accounting, the provision of data to the competent authorities where required by law, the defense of our interests in court, etc. The basis for processing in such cases may be, where mandatory, your consent, or our legitimate interest or compliance with mandatory legislation.

  • In all of the above cases, the company processes personal data only to the extent necessary to achieve the relevant clearly defined, and legitimate purposes, taking into account the protection of the data subject's privacy.

  • The Company shall ensure that personal data are processed accurately, fairly, and lawfully, that they are processed only for purposes that are consistent with the purposes identified prior to the collection of the personal data, and that they are processed only in strict compliance with the clear and transparent requirements for the processing of personal data as set out in the legislation.
     

How do we store your data?

For the processing of your personal data, the company has implemented appropriate organizational and technical security measures to protect personal data against accidental or unlawful destruction, alteration, disclosure, or any other unauthorized processing. The Company's security activities include but are not limited to, the protection of personnel, information, IT infrastructure, and internal and public networks.

Who do we provide your data to?

We may provide your data to:

  • Data processors (subcontractors) who provide services to us and process your data on behalf of the Company as the data controller and other companies as independent data controllers. Please note that processors have the right to process personal data only on our instructions and only to the extent necessary for the proper performance of their contractual obligations. When using subcontractors, we take all necessary measures to ensure that our processors have also implemented appropriate organizational and technical security measures and maintain the confidentiality of personal data. Purpose of processing: Email service, which stores the contact information you provide via the website, analytics and statistics about website usage.

  • Data processors may be established outside the Republic of Lithuania, the European Union, or the European Economic Area. If we transfer your personal data to such processors, we will take all necessary measures provided for by law to ensure that your right to privacy continues to be adequately protected.   • To other third parties where such provision is necessary and not contrary to law.

We may also provide your data:

  • In response to requests from a court or public authority, only to the extent necessary for the proper enforcement of applicable law or a court order/certificate.
     

How long do we keep your data?

We do not keep your personal data for longer than the purposes of the processing or the law requires if it provides for longer retention. Data collected for direct marketing purposes is kept until you withdraw your consent.


We aim not to store outdated or unnecessary information and to ensure that personal data and other customer information are kept up-to-date and correct.

  • to ask the company to rectify your personal data and/or to suspend the processing of such personal data, with the exception of storage, in the event that, after consulting the personal data, you find that the data is incorrect, incomplete, or inaccurate;

  • to request the company to erase personal data or to suspend the processing of such personal data, except for the storage, in the event that, after having access to your personal data, you discover that the personal data are being processed unlawfully or fraudulently;

  • request the company to transfer your personal data to another controller or processor;

  • object to the processing of your personal data where the processing is carried out or intended to be carried out for direct marketing purposes or for the legitimate interest pursued by the company or by the third party to whom the personal data are provided.
